TERMS OF SERVICE FOR CUSTOMERS

Last Updated: July 2, 2026 Welcome to Naples Deals. Please read these Terms of Service ("Terms") carefully. By purchasing any deal voucher on the naples.deals/deals page (the "Service"), you ("Customer" or "You") agree to be bound by these Terms.

1. No Refunds Policy

All Sales Are Final: All voucher purchases made on Naples Deals are non-refundable. No Expiration on Paid Value: Because the actual dollar amount you paid for the voucher never expires, refunds are not issued for unused, forgotten, or unwanted vouchers.

2. Voucher Value & Expiration Rules

Per Florida and federal laws, your voucher contains two distinct values: Paid Value (Purchase Amount): The actual cash amount you spent to buy the voucher never expires. If you do not use the voucher within the promotional window, the merchant must still honor the exact dollar amount you paid as a cash credit toward their goods or services indefinitely. Promotional Value (The Deal): The bonus discount, free item, or special package advertised in the deal expires exactly six (6) months from the date of purchase. Blackout Dates: Vouchers are subject to specific blackout dates (e.g., holidays, peak weekends) chosen by the merchant. You are responsible for reviewing these restrictions on the deal page prior to purchase.

3. Chargeback & Dispute Restrictions

TOS Violation: Filing a chargeback or payment dispute with your bank or credit card company for a validly delivered digital voucher is a direct violation of these Terms. Account Consequences: Initiating a chargeback will result in the immediate and permanent deletion of your customer account, the cancellation of all other active vouchers you have purchased, and a permanent ban from using the naples.deals platform.

4. Governing Law & Venue

These Terms and any dispute arising out of your purchase shall be governed by and construed in accordance with the laws of the State of Florida. Any legal proceedings or arbitration must take place exclusively in Naples, Florida.

5. Dispute Resolution

Any controversy or claim arising out of or relating to a voucher purchase shall be settled by binding arbitration administered by the American Arbitration Association in Naples, Florida. You waive any right to participate in class-action lawsuits or class-wide arbitration against Naples Deals or its participating merchants.

6. Limitation of Liability

Naples Deals acts strictly as a marketplace platform connecting consumers with local merchants. Naples Deals is not responsible for the quality, safety, legality, or delivery of the goods or services provided by the merchant. In no event shall Naples Deals be liable for any damages exceeding the exact amount you paid for the specific voucher in question.

7. Indemnification

You agree to indemnify and hold harmless Naples Deals and its affiliates from any claims, losses, or legal costs arising from your violation of these Terms, your misuse of a voucher, or your fraudulent initiation of a credit card chargeback.

8. Termination of Service

We reserve the right to suspend or terminate your access to Naples Deals at any time, without notice, for fraudulent activity, chargeback abuse, or any other breach of these Terms.

9. Force Majeure

Naples Deals and its merchants are not liable for a failure to perform or delays in honoring vouchers caused by events outside our reasonable control, including natural disasters (such as hurricanes), state or local emergency orders, or widespread internet or payment network outages.

10. Entire Agreement

These Terms, along with our Privacy Policy, constitute the entire agreement between you and Naples Deals regarding your voucher purchases, overriding any prior verbal discussions or advertisements.

11. Severability

If any provision of these Terms is deemed unlawful or unenforceable by a Florida court, that specific provision will be removed or modified to the minimum extent necessary, and the rest of the Terms will remain fully enforceable.

12. Modifications to Terms

We reserve the right to update these Terms at any time. The "Last Updated" date at the top of this page will reflect the most recent changes. Your purchase of any voucher after updates are posted constitutes complete acceptance of the revised Terms.

13. Assignment

You may not transfer your rights under these Terms to another party without our consent, though you may gift a valid voucher to another individual. Naples Deals may freely transfer its rights and obligations under these Terms at any time without restriction.
