Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Naples.Deals website at https://naples.deals operated by Cuccaro Media, LLC ("Naples.Deals," "we," "us," or "our"). By using the Site or making a purchase, you agree to be bound by these Terms.

1. About Naples.Deals

Naples.Deals is a curated local-deals marketplace connecting consumers with upscale Naples, Florida businesses. We are not a party to the underlying transaction between you and the merchant; we act as payment intermediary and voucher-management platform.

2. Eligibility

You must be at least 18 years old and able to form a binding contract under Florida law to use the Site.

3. Account Registration

You agree to provide accurate, current information and to keep your password confidential. You are responsible for all activity under your account. Notify us at legal@naples.deals if you suspect unauthorized use.

4. Deal Purchases and Vouchers

4.1 What You Receive

- - Cash Value — equal to the purchase price. Never expires.
  - Promotional Value — any bonus value above the purchase price. Expires six (6) months from purchase and is forfeited if unused after that date.

4.2 Payout to Merchants

Upon your purchase, the cash-value equivalent (less the platform fee) is transferred to the business via Stripe Connect. The platform retains no ongoing liability for the cash portion after this transfer.

4.3 All Sales Final

All purchases are final except as described in our Refund & Returns Policy.

5. Redemption

Present your voucher QR code to the merchant. Promotional value is applied first, followed by cash value. Partial redemptions are supported; remaining cash balance carries forward. Naples.Deals is not responsible for merchant equipment failure.

6. Prohibited Conduct

- - Purchasing deals for resale or commercial redistribution
  - Attempting to circumvent the QR redemption system
  - Sharing account credentials
  - Submitting false or fraudulent information
  - Using automated tools to scrape or crawl the Site

7. Payments and Billing

All transactions are processed by Stripe, Inc. By making a purchase you also agree to Stripe's terms (stripe.com/legal). We do not store your full credit card number.

8. Privacy

Your use of the Site is governed by our Privacy Policy, incorporated into these Terms by reference.

9. Intellectual Property

All Site content is owned by or licensed to Cuccaro Media, LLC and protected by U.S. and international copyright law. You may not reproduce or distribute it without written consent.

10. Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY FLORIDA LAW, NAPLES.DEALS' AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC VOUCHER GIVING RISE TO THE CLAIM OR $100, WHICHEVER IS GREATER. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES.

12. Governing Law

These Terms are governed by the laws of the State of Florida. Disputes shall be resolved exclusively in state or federal courts in Collier County, Florida.

13. Changes

We may update these Terms at any time. Continued use after notice constitutes acceptance.
